Are you planning a party and wondering where to host it in Croydon? Look no further!
These Terms and Conditions set out the basis on which Waste Disposal Croydon provides waste collection and related services to residential and commercial customers. By booking any waste disposal, rubbish clearance, bin collection, bulky waste removal or associated service with us, you agree to be bound by these Terms and Conditions.
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the individual, business or organisation that requests or pays for the services.
Company, we, us or our means Waste Disposal Croydon, the provider of waste collection and disposal services.
Services means any waste removal, waste collection, rubbish clearance, recycling, bin collection or similar service we provide, whether on a one-off or regular basis.
Waste means any items, materials, rubbish, refuse or goods that the Customer asks us to collect and remove.
We provide waste disposal and collection services within Croydon and surrounding areas, including household waste removal, commercial waste collection, bulky item collection and recycling services where reasonably practicable.
The exact nature, timing and price of the Services will be confirmed at the time of booking or in subsequent written confirmation issued by us. Certain waste types, including hazardous, clinical and specialist waste, are subject to restrictions and may not be accepted unless we have explicitly agreed in advance and confirmed any applicable additional charges and conditions.
3.1 A booking for Services may be made by telephone, email or through our online booking system, where available. All bookings are subject to availability and our acceptance.
3.2 When you make a booking, you must provide accurate and complete information, including the service address, access instructions, type and approximate volume or weight of waste, and any special requirements. We rely on the information you provide when giving price estimates and planning the collection.
3.3 Any quotation given before we attend the property is an estimate only and may be revised if, in our reasonable opinion, the description, volume, weight or nature of the waste differs from that originally described, or if access conditions are more difficult than indicated.
3.4 A booking is only confirmed when we issue a confirmation by email or other written communication, or when we expressly confirm the booking by telephone and you agree to the date, time window and applicable charges.
4.1 The Customer must ensure that our staff, vehicles and equipment have safe, convenient and lawful access to the collection point at the agreed time. This includes ensuring any necessary parking, loading or permit arrangements are in place.
4.2 Waste must be presented in a safe and manageable manner. Where possible, items should be bagged or securely contained. Bulky items should be dismantled where reasonably practicable, unless otherwise agreed.
4.3 The Customer is responsible for ensuring that the waste presented for collection is lawful and suitable for collection under these Terms and Conditions. Prohibited or restricted waste types must be disclosed in advance.
4.4 If we are unable to perform the Services because of inadequate access, unsafe conditions, incorrect information or the presence of prohibited waste, we may cancel or postpone the collection and may charge a call-out or wasted journey fee.
5.1 We generally accept typical household and commercial waste, including general rubbish, furniture, appliances, garden waste and similar items. Some items may incur additional charges due to special handling or disposal requirements.
5.2 We do not normally accept hazardous, toxic, explosive or specialist waste, including but not limited to asbestos, clinical waste, chemicals, solvents, oils, gas cylinders, fuel, paint in liquid form, explosives and pressurised containers, unless previously agreed in writing and arranged through appropriate licensed channels.
5.3 Where you present such prohibited or restricted waste without prior disclosure, we may refuse to collect it, terminate the collection, or arrange separate handling at additional cost. You will be responsible for any fines, penalties, costs or liabilities arising from undisclosed or improperly presented hazardous or prohibited waste.
6.1 Our charges are based on a range of factors such as the volume of waste, its weight, the type of materials, the labour required, access conditions and any applicable disposal or recycling fees.
6.2 Any prices given in advance of collection are estimates only, based on the information you provide. The final price will be confirmed on site once our staff have inspected the waste and assessed the work required.
6.3 If the actual waste differs significantly from that described at the time of booking, or if the job requires substantially more labour or time due to access or other issues, we may revise the price. If you do not accept the revised price, we may cancel the job and reserve the right to charge a call-out fee.
7.1 Unless otherwise agreed in writing, payment is due in full on completion of the Services. We may accept card payments, bank transfers or cash, subject to our current payment methods.
7.2 For business customers, we may at our discretion offer account facilities or payment terms. Where such terms are agreed, invoices must be paid in full by the due date specified. We may charge interest on overdue sums at the statutory rate together with any reasonable debt recovery costs.
7.3 We reserve the right to require a deposit or advance payment before attending the property, particularly for larger collections or repeat waste disposal services. Any deposit will be offset against the final invoice.
8.1 You may cancel or amend your booking by giving us reasonable notice before the scheduled collection time.
8.2 If you cancel more than 24 hours before the agreed collection time, no cancellation fee will normally apply. If you cancel within 24 hours, we may charge a reasonable cancellation fee to cover our costs and lost time.
8.3 If our team attends the property at the agreed time and is unable to carry out the work due to your late cancellation, lack of access, or because you are not present where required, we may treat the booking as cancelled and charge a call-out or wasted journey fee.
8.4 We may cancel or reschedule a booking if we are unable to perform the Services due to circumstances beyond our reasonable control, including extreme weather, traffic incidents, vehicle breakdowns, staff illness or compliance with legal obligations. In such cases we will seek to rearrange the collection as soon as reasonably practicable.
9.1 We will use reasonable care and skill in providing the Services and will aim to attend within any agreed time window, although time is not of the essence and delays may occur.
9.2 Our staff will load the waste into our vehicle and will take reasonable steps to minimise disruption at the property. However, the Customer should remove or protect vulnerable items and surfaces in areas where staff will be working.
9.3 Once the waste has been loaded onto our vehicle and we have left the site, ownership and responsibility for that waste passes to us and you will not be entitled to reclaim any items.
10.1 We aim to divert waste from landfill where reasonably possible by prioritising reuse, recycling and responsible disposal routes. The precise method of disposal or recycling will be at our discretion, in compliance with applicable law and regulations.
10.2 We will only use licensed waste transfer stations and authorised facilities for the processing and disposal of waste, and we will maintain appropriate records as required by law.
11.1 We operate in accordance with relevant UK waste management legislation, including duties relating to the storage, transport and disposal of controlled waste.
11.2 Business customers may be required to keep their own records and documentation confirming how their waste is handled. Where applicable, we will provide standard documentation such as waste transfer notes to demonstrate compliance.
11.3 The Customer must not ask us to dispose of waste in an unlawful manner and must cooperate with any reasonable requests for information necessary to comply with waste regulations.
12.1 Nothing in these Terms and Conditions limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot lawfully be limited or excluded.
12.2 Subject to the paragraph above, our total liability to you for any loss or damage arising out of or in connection with the Services, whether in contract, tort or otherwise, shall not exceed the total amount paid or payable by you for the specific Services giving rise to the claim.
12.3 We shall not be liable for any indirect or consequential loss, loss of profits, loss of business, loss of opportunity or loss of goodwill arising out of or in connection with the Services.
12.4 You are responsible for securing or removing fragile, delicate or high-value items from areas where our staff will be working. We will not be liable for minor cosmetic damage to walls, floors or fixtures reasonably incidental to the removal of bulky items, provided our staff have exercised reasonable care and skill.
13.1 The Customer agrees to indemnify us against all claims, costs, damages, fines, penalties and expenses arising from:
a. Any breach by the Customer of these Terms and Conditions.
b. The presentation of hazardous, prohibited or incorrectly described waste.
c. Any failure to obtain necessary consents, permissions or access rights for the performance of the Services.
14.1 We maintain appropriate insurance cover in respect of our legal liabilities arising from the provision of the Services. Details of our insurance can be provided on reasonable request.
15.1 We will collect and process personal data provided by you for the purpose of managing bookings, delivering Services, processing payments and meeting legal obligations.
15.2 We will take reasonable steps to keep personal data secure and will not sell your details to third parties. We may share data with trusted service providers where necessary to perform the Services or comply with the law.
16.1 If you are dissatisfied with any aspect of our Services, you should contact us as soon as possible, providing details of the issue and any supporting information.
16.2 We will investigate complaints promptly and aim to resolve them in a fair and reasonable manner. Where an error is found, we may, at our discretion, offer a remedy such as a partial refund, re-attendance or other appropriate solution.
17.1 We may amend these Terms and Conditions from time to time to reflect changes in law, industry practice or our operational requirements.
17.2 The version of the Terms and Conditions in force at the time of your booking will apply to that booking, unless a change is required by law or regulation.
18.1 If any provision of these Terms and Conditions is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be removed or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
19.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.
19.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the provision of our waste collection and disposal services.
20.1 These Terms and Conditions, together with any written quotation or confirmation of booking issued by us, constitute the entire agreement between you and us in relation to the Services. You acknowledge that you have not relied on any statement, promise or representation that is not set out in these documents.
